As for the Egyptian law.there is ano bankruptcy law.Still if we find an Egyptian lawyer on no win no fee.They take their fee from the other party.The case still open. This what I am intend to do. Wait after Covid, will let you know. 2 things in our favour. 1-the first court verdict. 2.All the investors foreigners. Never give up Colin I have seen cases like that in Egpyptian court. Hi Alain, It looks like we have reached the end of the road and those that had robbed us have got away with it! It is very frustrating and sad . Rob has said there is no point in pursuing this as the lawyers are hopeless and keep requesting more money for doing nothing. I have also lost a lot of money and many years fighting this, but what other options are open to us? If you have any ideas please post them on this site or anyone else reading this. As faith in lawyer is indeed quite limited , as they are only motived by quick money, as for me I cannot stop like this, as strategies no cur/ no pay or pay all before waiting some good working with lawyers working like young childrens , I propose next strategy : work/ pay step by step , objective by objective. El Sharkawi states that he would need to do extra research but without a no win, no pay agreement in place! But further on he states that he is willing to half his Euro 7,000 fee with a no win, no pay agreement! Which is it? Also he states that he needs to study why Wallaa El-Elfy cannot be sued in a civil case - surely as a member of the Egyptian bar association he would know the criteria for a civil suit and not need to study it!! He also says that he would need to study the period of limitation in such cases, again, as a lawyer, this is something he would already have knowledge of, working as a lawyer in the Egyptian courts. This is all very suspicious and raises more questions than answers.Mr Sharkawi had already studied the case for. £1000 Now he wants extra £3000 to study the case More to give us his opnion This is Total. Hi all, As a result of the investigation of the lawyer last year, which was already a last option we had at that time, we can only vote for option 3. Still willing to proceed (which would be option 1). However, only with a serious plan, which is not the plan currently presented to us. It is still not giving us a result. It needs to have another approach and I would think that this lawyer will need to make the investment to tell us in person. To explain what has happened, what is needed more. A lawyer on our side to challenge him. Furthermore we will need to be on top of the case. We need to be in Egypt, to be able to have a steering committee having in depth knowledge (not saying they are not having this, but currently there is no actions carried out, only by Mondi). Hi all, we would like to go for option one, under the condition that there are enough other investors that are willing to share the cost. For us, a reasonable amount would be +- 350 €, which means we need about 20 investors (20 × 350 = 7000)that are willing to proceed with the case. What we need to know is that 7000 Euros is the expected final cost or not. Or is it going to be higher and is there any chance to reduce it or not. As well if our lawyer can get part of his fees from the confiscated assets of Wallaa if he wins.we want to proceed (1), but it is depending how many investors will be also proceeding for the cost. Please inform regularly perhaps with an xls file to how many want such or such option. As I expected,I had already given up all hope of recovering any monies but hoped we may get some sort of justice. This has been ongoing for quite some years now with more and more cash thrown down the drain . I would ideally like to continue but let’s get real this has been a lost cause for some time and throwing even more money in would just be as every other year, bad enough loosing the original investment but rubbing it in with more Mondi fee renewals, lawyers costs etc is a joke

The name Sea Island exists, because every year when I go to Egypt we passed the place where Sea Island must be and there is still a plate with the name on.

Thank you Rob for the update from the lawyer. This is the first time that I am hearing that there is no land under the name of `Sea Island`! Did we buy a bucket of sand each! If El Alfy was found guilty of criminal charges against the investors and given a prison sentence, why has he not been arrested and his assets seized? We would have had a claim against these assets. If looks like this lawyer has been just out to fleece us and has been sitting on his hands for the past few years. He had agreed to be paid only if he was successful, he now wants more money, for what?? He just seems to be making excuses for his failure to do anything. I really don`t know where we go from here and would welcome any suggestions from my fellow investors. This has been a very long road with many false promises . I am still very aggrieved that El Alfy and his cronies stole our money and now seem to be getting away with their crime. Looking forward to your responses. Colin

I have lost all faith in positive outcome. I would say we take the last steps as Rob proposes. If again no reaction or some positive feedback is coming we close this file. I do not want to invest more money. Thx Rob and steering com. for all effort. I can imagine that also for you the outcome after all this time is frustrating. Justice will not prevail. I take my loss.

Hi Rob/Investors I have tried emailing you privately several times but your only response was to say that you will post something on the website in `short time`? I think everyone just wants to know what the current situation is and if there is any plan going forward. We have all spent a lot of money and time, jumping through hoops to get requested documents for the lawyers. Good Morning Everyone. If there is enough interest amongst the 22 investors then I will give it one last shot, but with reservations. Reading between the lines, I am assuming the new lawyer, El-Sharkawi, is going after Philip Morris, am I correct in this assumption? Around the year 2011, I personally tried to make contact with Morris via email and got a response saying that he would not reply further as I was not one of his clients. (I am trying to find this email , did I not send a copy to you Rob)? Subsequent to this I also laid a charge with the UK Fraud Squad and the Law Society of UK, without any luck (I do have all these correspondence if needed. I have always highlighted the fact that our contracts are with El Alfy`s company, and cannot understand why our so called lawyers have not gone after this company. I look forward to an English translation of the meeting, so I can understand exactly what the intentions of Mr -El-Sharkawi will be, and what the cost implications are going forward. Everyone has paid a lot of money already and we just seem to have gone backwards. As I see it, we are either in or we are out. I for one would rather fight to get our money back. I know this does involve more expenditure, but if everybody contributes then it is not so much per person. I will most certainly contribute to the 1000 Euros asked for. Why is the law such an ass.?

I am in for investigation even if I do not have a lot of faith anymore that after all these years it will come to a positive outcome. It is unbelievable that we have also been misled by our current laywer. If after the investigation the laywer sees chanches to file cases than it all depends for me on the cost if I will decide to go on or not. To be honest. I am only member of Mondi because of this case, so when it takes 10 years next to the cost of the laywer there is also 10 years membership fee.

Firstly, I do not understand why our Attorney did not check out the existence of El Alfy and his company before proceeding with the case. You would think it would be the most logical first step! Hi Ghaleb, In your post you stated that Mr Al Alfy was sitting in his office in Cairo. Perhaps you could pass on this address to Rob, as our lawyers seem unable to locate him.

News of today sounds that instead of progression the lawyers are easily steppen back from duties. It is no surprise to me that assets as well as people involved have moved away from the crime scene. Especially as so many years have passed. As Mondi and the SC have left us in the dark confirming updates with information that progression was on the move, I hope they can shine a light on the situation and give us a heads up!
