Mevr. Eva van Dam over Blees Estates

We were very impressed with the Blees Estate owner from our first meeting during the Second Home Fair in early 2006. The “can do” and “anything is possible” attitude gave forth to high expectations. Being very excited over our “dream retirement home”, we made monthly trips to Turkey to follow the construction, and convey our desires regarding the project. When we requested specific desires, e.g. location of interior walls, electrical outlets, ceiling lighting and etc., we were asked to make a list, which we did on numerous occasions. Even though specific drawings were furnished, we were quick to learn that the “list” was not read, or there was a serious lack of attention to detail by management (electrical outlets were behind cabinet drawers and inside closets and ceiling light outlets were in the wrong place). We also discovered, much to our disappointment, there was a serious lack of transparency in the billing for the extra work performed. When questioned about perceived discrepancies in the billings, e.g. labor charges and materials, we were unable to convince Blees Estate Management of the errors. Our electricity was even turned off when the temperature was over 39 degrees because we did not pay one bill we felt was seriously exaggerated and was not sufficiently explained. We were forced to pay the bill in order to have electricity again. To compound the hurt we were charged an extra TL 200.00 to have our electricity turned back on. Regarding our TAPU: In December 2006, we (house owners) were assured our TAPU (Title Deed) would be issued in April or May 2007. On numerous occasions in 2007and early 2008, we all inquired about the TAPU, we were told that they were waiting for the final approval of the Turkish Military. Thinking the Turkish Military may be slow in giving their approval and there was nothing Blees Estate could do, we continued to be patient over the issue. It was not until April 2008, that we discovered the real problem regarding the issuance of the TAPU. To our astonishment and shock, we discovered that Blees Estate owned only 50% of the property. The other 50% was owned by a previous partner. Thus, Blees Estate sold us property that was not completely theirs to sell. To compound the problem, we also found out there were numerous Turkish Court registered claims against all the properties in the estate, amounting to over Euro 100.000,00, due to the ex-partner having financial and Turkish Tax problems. Thus, we were forced into hiring an attorney at great expense to solve this problem. When the attorney checked for the Military Permission, he discovered all permissions had been issued by February 2007, even though Blees Estate Management told us as late as early 2008 they were still waiting for the permission. It then became evident that we were being lied to by Blees Estate Management and that they were covering up the fact that they illegally sold the property to us, and were having serious problems solving the problem with the ex-partner of the ownership. It wasn’t until the middle of December 2008, that Blees Estate was forced into making a settlement with the ex-partner, thus enabling the issuance of our TAPU. BUT, that wasn’t the end of our problems with Blees Estate. Initially three house owners had telephones and ADSL installed in our homes. As Blees Estate was the owner of the houses, the telephones and ADSL connections had to be in the name of Blees Estate, even though each house owner paid their own bills. Immediately after the issuance of the TAPU, without notification to the house owners, all telephone and ADSL contracts with Turkish PTT were cancelled by Blees Estates, requiring each of us to re-accomplish all paper work with Turkish PTT, and receive new telephone numbers. Additionally, In order for us to live in our new homes, permission from the local government (Iskan) must be given. Blees Estate is contractually required to obtain this permission. However, due to a serious landslide and erosion problems on the estate, which the local government stated is a dangerous situation for inhabitants as well as the houses, they will not give this permission until a proper retaining wall to prevent further erosion and landslides is constructed. The retaining wall has not been constructed as yet, even though Blees Estate has agreed a wall should be constructed and all levels of local government has insisted it be done since the spring of 2009. We are still waiting for Blees Estate to begin to accept their contractual responsibility regarding the Iskan. Without an Iskan, we must pay a higher price for our electricity, because the estate is still considered a construction site. Some people may say we were short on patience, however in truth we were consistently lied to by Blees Estate Management regarding our TAPU. The situation has now degraded to the point that Blees Estate will not even enter into a serious discussion with any of the house owners on this estate regarding neither our current problems nor the Iskan. In all honesty, I must add Blees Estate delivers solidly constructed houses, with very nice views. The houses are also well thought out and nicely designed.
